AC Mizal & Wife File RM25 Million Suit Against Newspaper Envoy



Singer and lawyer Datuk Mizal Zaini otherwise known as AC Mizal with his wife Datin Emylia Rosnaida Abdul Hamid and two others filed a defamation suit against Utusan Melayu (M) Sdn Bhd and three others, claiming damages of RM25 million.
AC Mizal who is also President of the Peace Yall Sdn Bhd, the company which operates the private internet broadcasting radio channel, filed the suit through Messrs Shahrir & Co. on March 30.
The plaintiffs in the suit are AC Mizal, 45, Emylia Rosnaida, 43, who is also vice president of the company, Rashidi Ishak, 43, chief executive officer of the company and Peace Yall Sdn Bhd.


They named Utusan Melayu entertainment journalist, Syed Syed Mahdi Irvan, a former editor of a weekly Malaysia Ku Seman Ku Hussein, chief editor of Utusan Melayu Datuk Abdul Aziz Ishak, and Utusan Melayu as the first four defendants.
According to the statement of claim, the plaintiffs alleged that Syed Irvan through insertion Pancaindera published together with Mingguan Malaysia assumed libel against the plaintiffs in the article entitled "Peace Yall FM Unpaid Wages'.

They claimed that the words in the article describing the plaintiffs an employer, the company's president, businessmen, members of the community or individuals who are irresponsible, careless, and negligent towards their employees.
The plaintiffs claimed that the words can also describe their reputation or business severe financial and unreliable, are burdened by debt or severe financial and unable to pay the salaries of employees.
They claimed that the reputation and good name as a businessman and activist art has been hit hard.


They are seeking general damages for defamation of RM15 million and RM10 million in aggravated damages, costs and other relief deemed fit by the court.
Baharuddin Ahmad Shahrir lawyer representing the plaintiffs told reporters after the proceedings in chambers of Judge Abu Bakar Jais today, informed the court suggested the two sides to resolve the defamation case through mediation.
He said the court set tomorrow for case management. Also present at the proceedings was a lawyer Ooi Yi She, who represented the defendants.
